Pursuant to the Notice of Investigation (58 Fed. Reg. 13277-28 (March 10, 1993)),this is the administrative law judge's final initial determination, under Commission interim rule 210.53 (19 C.F.R. section 210.53). The administrative law judge hereby determines, after a review of the record developed, that there is no violation of subsection (a)(1)(B)(i) of the Tariff Act of 1930, as amended (19 U.S.C. section 1337), in the importation into the United States, the sale for importation, or the sale within the United States after importation, of certain anti-theft deactivatable resonant tags and components. Complainant Checkpoint filed a petition for a review of the ALJ's findings on both infringement and validity; respondents and the Commission investigative attorney (IA) filed responses to the petition for review, and all parties filed reply submissions. Having considered the record in this investigation, including the ID and all submissions filed on review, the Commission determined not to review any portion of the ID. The Commission also determined that issuance of a remedy as to defaulting respondent CSI is precluded by public interest factors.
