Analysis of Policy Issues Relating to Public Investment in Private Freight211 Infrastructure

The Norman Y. Mineta International Institute for Surface Transportation Policy211u001eStudies (IISTPS) at San Jose State University conducted this study to review the 211u001eissues and implications involved in the investment of public funds in private 211u001efreight infrastructure. After thorough legal research, the project team reached 211u001ethe following conclusions: (1) The California legislature has the legal power to 211u001einvest public funds in privately-owned freight infrastructure projects; (2) State 211u001eHighway Funds, expecting gas tax revenues, may be used for investment in freight 211u001einfrastructure projects; (3) Gas tax revenues are restricted to highway use by 211u001ecurrent interpretations of the California Constitution (A challenge to this 211u001einterpretation is not recommended); and (4) Gas tax revenues may be invested in 211u001eroadway segments of freight infrastructure projects.
