In accordance with the Magnuson-Stevens Fishery Conservation and Management Act, this assessment identifies the potential impacts of the National Park Service (NPS), Gateway NRA, Sandy Hook Unit proposed Sand Slurry Pipeline on essential fish habitat (EFH) at Sandy Hook, New Jersey. The Magnuson-Stevens Act as amended by the Sustainable Fisheries Act of 1996 (Public Law 104-267) set forth a number of new mandates for the National Marine Fisheries Service (NMFS), regional fishery management councils, and other federal agencies to identify and protect important marine and anadromous fish habitat. The councils, with assistance from NMFS, are required to delineate 'essential fish habitat' for all managed species.
