Polyvinyl Alcohol from Taiwan. Investigation No. 731-TA-1088 (Preliminary) (Remand)

In October 2004, the United States International Trade Commission (Commission) determined that there was no reasonable indication that an industry in the United States was materially injured or threatened with material injury by reason of subject imports of certain polyvinyl alcohol from Taiwan that were allegedly sold in the United States at less than fair value. The U.S. Court of International Trade subsequently issued an opinion in an action challenging the Commissions determination. The Courts decision affirmed the Commissions negative preliminary determination in part and remanded it in part. Upon consideration of the Courts remand instructions and the parties comments on the Courts opinion, and based on the information available at the time of the original preliminary determination, the Commission determines that there is a reasonable indication that an industry in the United States is materially injured by reason of subject imports of certain polyvinyl alcohol from Taiwan that are allegedly sold in the United States at less than fair value.
