The content and methodology for development of the Model Housing Licensure Act are presented, the Act representing an attempt to upgrade the standard of performance of housing managers through licensure. Traditionally, the only licensing laws applicable to housing managers were real estate licensing laws, which, for the most part, dealt with the rental aspects of housing management. The Model Act is the first legislation to recognize the housing management profession as a separate and distinct profession and to treat the related job functions comprehensively. The purpose of the Act is to protect the public by establishing and maintaining a high level of professional competence among managers. It creates a Commission on Housing Management Licensure to administer all aspects of the Act as an agency distinct from the State real estate commission. The Commission will be appointed by the Governor and will be composed primarily of housing managers together with some public members. Performance without a license of any functions covered by the Act is a misdemeanor. The Act requires the Commission to establish an 'Eligibility Requirements Statement,' which would include general requirements such as residency and age of majority, and specific requirements for previous experience, education, and testing. The Commission is given the power to refuse, revoke, and suspend licenses and to issue fines for itemized grounds. The Act also provides a fund to reimburse any person who is aggrieved by certain acts of a licensee in which damage is incurred. A sample of the Act is provided with commentary.
