Revision of Class Damage Procedures: Empirical Studies

The volume is a compilation of four reports prepared over a two-year period in support of a Justice Department proposal for comprehensive revision of the federal procedure governing the class damage action. The studies provide better estimates of the impact and costs of the suggested revision in federal procedure. The first study, which encompasses two reports, examines the fiscal impact on the government of the proposed legislation. The second study examines the participation of small business over the last decade in antitrust class damage actions, to estimate the impact of the reform on small business. The final study estimates the amount of unclaimed recoveries that 'escheat' to the government after mass, small claim actions, and the extent to which these funds are used for subsequent enforcement.
