Building Regulations and Existing Buildings: Improved Techniques for Regulation of Existing Buildings

This report outlines the generic elements and component activities of an effective system for regulating existing buildings. It also outlines an approach for establishing such a system in a community. An effective system recognizes the general, organizational, operational, and educational features, the special resources, and the social supports involved. General features include attitudes of regulatory officials, the proliferation of regulatory organizations as well as the proliferation of regulatory codes and statutes, and the monitoring and evaluation procedures. Operational features include recordkeeping, access, and review, monitoring occupancy and use changes, triggering mechanisms, inspection, prosecution of violators, training of occupants and public education, and code maintenance and change. Extending regulatory personnel and information are treated as special resources. Supports stem from the political, statutory, legal and public spheres. The process for establishing a locally appropriate and effective regulatory system for existing buildings requires data on existing regulatory systems with comparisons of regulations for existing and new buildings as well as on general community and building characteristics. Data analysis should yield a model synthesis of a regulatory system for existing buildings, to be followed by program implementation. Research needs include interdisciplinary local level discussions, case studies of effective regulatory programs, and attention to special problems of smaller jurisdictions.
