A State-by-State analysis of laws affecting the formation and operation of health care institutions in DHEW Region IV is provided as part of a 19-volume study to explain and identify the legal and organizational problems likely to confront planners and sponsors of health care institutions in all 50 States. Eight States compose Region IV: Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina, and Tennessee. Two primary types of laws are examined: laws authorizing the organizational forms potentially available to health care institutions, and laws regulating the formation and operation of health care institutions. The States' legal climate for development of health maintenance organizations is emphasized. The relevant provisions of selected statutes are described for each State, followed by a summary of the legal climate for innovative health care institutions. Four traditional, legal organization forms for health care institutions are described for profit business corporations, nonprofit corporations, general partnerships, and limited partnerships. Other forms of government regulation are also outlined.
