A State-by-State analysis of legal forms of organization available to health care delivery institutions in the four States composing DHEW Region IX is part of a 19-volume study to identify and explain the legal and organizational problems of health care institutions. The four States of Region IX are: Arizona, California, Hawaii, and Nevada. Two primary kinds of laws are examined for each State in the region: laws authorizing the organizational forms available to health care institutions and laws regulating the formation and operation of health care institutions. The emphasis is on each State's legal climate for the development of health maintenance organizations. The relevant provisions of the statutes are described for each State, as is the legal climate for innovative health care institutions. Four traditional legal organization forms for health care institutions are outlined for each State: for-profit business corporations, nonprofit corporations, general partnerships, and limited partnerships. Other forms of government regulation are also discussed.
