Protection of Medical Units under the Geneva Conventions in the Contemporary Operating Environment

The Geneva Conventions, along with their Additional Protocols, represent the fundamental documents on which the Law of Armed Conflict (LOAC) is established. Originally established under the premise of conventional warfare, these documents have been the cornerstone of U.S. Army doctrine in providing direction to U.S. forces in adherence to the LOAC. The Global War on Terrorism (GWOT) has put many U.S. medical units in a quandary: they must care for the wounded in combat while simultaneously providing adequate force protection for themselves, their patients, and their mission essential assets. To mitigate this, AMEDD units mostly depend on other units to meet theater force protection requirements, especially in the areas of base defense and security escorts. This dependency has many drawbacks. For example, medical ground evacuation missions are often delayed because medical units have to wait for adequate security escorts. There are other drawbacks as well to this dependency on external security, such as synchronizing communications and battle drills and using standard operating procedures with elements from different organizations. This thesis explores the possibility that the treaties of the Geneva Conventions, and/or corresponding layers of policies from U.S. Government agencies and the U.S. Army, may be outdated and/or over-restrictive with regard to warfare as it is being conducted on today's battlefield, the Contemporary Operating Environment (COE). Specifically, the thesis explores the possibility of allowing medical units to employ weapons of increased capability (e.g., machine guns and crew-served weapons), and the conditions and limitations under which such weapons should be utilized.
