The ITC as an attractive patent litigation forum for the biotechnology and pharmaceutical industry

The US International Trade Commission (ITC) is increasingly being used as a forum for patent litigation. Despite the rise in ITC filings, the biotechnology and pharmaceutical industries have not taken significant advantage of the unique benefits the ITC offers. Generally, disputes regarding IP rights are filed as lawsuits in a US district court. District courts have the authority to find infringement, award damages, issue injunctions, and provide other relief as appropriate for a party to the suit. However, IP litigation in the USA is notorious for high costs and lengthy case pendency.
