The preemption language in the new bipartisan TSCA reform bill has already drawn the ire of the Environmental Working Group and other NGOs, who worry that it could undermine a wide array of state regulatory efforts aimed at limiting public exposure to harmful chemicals. Industry groups argue the strong preemption language is warranted to rein in a patchwork of state rules and some experts contend a reformed TSCA would negate the need for states to tackle chemical policy.
