The most noteworthy decisions this month are the following:In Maine People's Alliance v.Mallinckrodt,Inc.,No.05-2331(1~(st)Cir.December 22,2006),Judge Selya,writing for the First Circuit Court of Appeals,affirmed a district court's finding for plaintiffs in a RCRA citizen suit and order of an expensive study and possible remediation remedy.The imminent and substantial endangerment standard of the statute was to be liberally applied and set a low hurdle.
