The most noteworthy decisions this month are the following:In United States v.Burlington Northern&Santa FeRailwayCompany,Nos.03-17125etal.(9~(th)Cir.March 16,2007),Judge Berzon,writing for the Ninth Circuit Court of Appeals,reversed a decision apportioning liability in a CERCLA section 107 action based on rough criteria of proportional responsibility.Factors such as percentage of property owned or time of ownership or volumetric contribution did not measure the variable of concern,which was site contamination.
