ACA refutes court ruling over amendments to SCAQMD Rule 1113

The American Coatings Association (ACA) disagrees with a Californian Supreme Court Ruling concerning amendments to Rule 1113 of the South Coast Air Quality Management District (SCAQMD). The ACA is concerned that the ruling provides the SCAQMD with the authority to impose pollution controls, based on technology that is not available for critical categories of coatings when the regulation is implemented. The Supreme Court has decreed that air pollution agencies may require pollution controls on technologies that do not yet exist, but are reasonably anticipated to exist by the compliance date. Although the Court's ruling is final, the ACA is assessing the best course of action to take having fully analysed the decision. It is also reported that as a consequence of Rule 1113 certain manufacturers have already ceased to sell coating products in Southern California.
