On May 3, and May 10, 2004, Plaintiffs, or their predecessors in interest, lease their mineral rights to Diamond Resources, Inc., through several separate leases. By various mesne assignments, the leases are transferred to Hess Corporation (Hess) on December 30, 2004. All of the leases are identical, having a primary term of five years, and each lease contains the following provisions.
