Stevens owns three tracts of land. In 1993, she is declared incompetent and Davis is named guardian or her estate and her person. Davis asks the probate court to sell one of the tracts but after Johnson and the other parties object, the probate court denies the request. Davis then executes a quitclaim deed purporting to transfer one of the tracts to the McClintocks. A subsequent quitclaim deed transfers another lot to the wife of the defendant McClintock.
