Following the denial of the petition for review filed with the Texas Supreme Court, the Court of Appeals issued in mandate. The Long Trusts file a motion for clarification seeking to challenge the court's severance of Castle's counterclaims and the recalculation of prejudgment interest at 12%. Because the time has passed when the Court of Appeals exercises plenary power over its mandate, the court is powerless to amend its original mandate. It therefore orders the trial court to sever the counterclaims for the purpose of recalculating prejudgment interest and entering judgment.
