Because multiple shippers use the Trans Alaska Pipeline System (TAPS) to transport different quality crude oil, TAPS uses a quality bank adjustment methodology so that the shippers tendering low-quality oil will pay more than the shippers tendering high-quality oil. A statute, however, limits FERC's power to make retroactive quality bank adjustments. The statutory limitation is adopted in response to a prolonged quality bank adjustment proceeding mat leads to a lengthy retroactive adjustment that is detrimental to Alaska-based refineries.
