Under the draft Transit Protocol,"where the duration of Transit Agreements does not match…the duration of supply contracts,a Contracting Party through whose territory Energy Materials and Products transit…shall ensure that the owners or operators of Energy Transport Facilities under their jurisdiction who are in negotiations on access to Available Capacity consider in good faith and under competitive conditions the renewal of such Transit Agree-ments…For the avoidance of doubt,it is understood that concerning conditions for access to Available Capacity the incumbent is treated no better and no worse than other potential users,and that such incumbent is first to be given an opportunity to accept the proposed renewal terms."
