For a discussion of the facts see the case summary of the Court of Appeal decision, 169 O.&G.R. 269. Held: reversed. The Supreme Court disagrees with the court of appeal's conclusion that the "real cause of action" in this case and the Tract 87 litigation is "the immovable known as the 1938 lease." Moreover, the court of appeal did not apply the correct elements for determining whether the Tract 87 litigation was res judicata. The Tract 87 litigation involved twp competing leases, one granted by the State and one granted by BLD.
