This case involves the certification of three questions from the Fifth Circuit that are based on the following factual scenario. In Re Moose Oil & Gas Co., 613 F.3d 521 (5th Cir. 2010). Moose Oil & Gas acquires several leases and assigns a portion of its working interest to a group of investors that includes Tawes. The owners of a tract of land adjacent to these leases, the Barnses, execute a lease that is eventually assigned to Dominion Oklahoma Texas Exploration and Production. Moose and Dominion execute several agreements, including a Working Interest Unit Agreement (WIUA) and a joint operating agreement (JOA).
