Brann has ruled that UGI Sunbury can condemn the properties of 11 sets of landowners in Pennsylvania to build a 35-mile natural gas pipeline with a nameplate capacity of 200 million cubic feet per day.Brann wrote that he did not have the legal right to question a property rights certificate given to the company by the US Federal Energy Regulatory Commission. In his ruling, Brann said Ferc's certificate of public convenience and necessity gives UGI Sunbury the authority to take the land.
