The fast pace of change in industrial relations and new regulation affecting the construction industry is continuing. The most recent developments of note are set out briefly here. National Code of Practice compliance: New regulations have now been issued under the BC11 Act which allow contractors to insist on subcontractors having "eligible conditions" in their industrial arrangements that include obligations to comply with the National Code of Practice for the Construction Industry (and associated Guidelines) without risk of being found to have engaged in unlawful discrimination. This will provide relief to contractors who, in order to be compliant with the National. Code, must ensure that their sub-contractors apply the terms of the National Code. Other "eligible conditions" which contractors are currently able to insist on are inclement weather provisions and particular hours and days of work.
