Missouri agency, EPA argue about review of air quality standards

The Missouri Coalition for the Environment (MCE) sued Michael O. Leavitt, the former administrator of the EPA, in the U.S. District Court for the Eastern District of Missouri, alleging that the EPA has neglected, ignored or otherwise failed to review the National Ambient Air Quality Standards (NAAQS) for lead at least every five years. In a companion case, the State of Missouri and state Attorney General Jeremiah W. Nixon sued Leavitt as administrator of the EPA in the Eastern District of Missouri, seeking declaratory and mandamus relief for violations of the CAA, 42 U.S. Code Section 7604(a)(2).
