Louise Pringle, on behalf of Tyree Ford, sued the Philadelphia Housing Authority (PHA) in Philadelphia County Common Pleas Court, alleging negligence and noncompliance, breach of the implied warranty of habitability, intentional infliction of emotional distress, negligent infliction of emotional distress and unfair trade practices and violations of the consumer protection law. The complaint also included causes of action for strict liability, ultrahazardous activity, third-party beneficiary, implied rights of action, 42 U.S. Code Section 1983, violation of PHA-HUD annual contributions contract, loss of consortium, punitive damages, violation of the Residential Lead-based Paint Hazard Reduction Act of 1992 and violation of Philadelphia Code Section 6-403(5) and Sections 6-802 through 6-813.
