Mississippi plaintiffs File in appeal to high court, say trial court erred

Shermeker Pollard, individually and on behalf of her son-Trellvion Gaines, sued Sherwin-Williams, NL Industries, Robert Case d/b/a Fayette Lumber & Supply Co., William Darsey, individually and d/b/a Darsey Hardware Co. and d/b/a Darsey Hardware & Furniture Co., and Hirsch's Store in the Jefferson County Circuit Court, alleging that they were involved in selling lead-based paints. The plaintiffs alleged strict liability, negligence, fraudulent concealment and misrepresentation and damages associated with Gaines' lead-poisoning injuries. On June 9, 2003, Judge Lamar Pickard adopted a special master's report that recommended granting Sherwin-Williams' motion for summary judgment in its entirety.
