N.Y. Justice: Some Insurers Dismissed In Lead Case Based On Policy Exclusions

A New York trial justice on Aug. 4 ruled that some insurers in an underlying lead-poisoning lawsuit did not owe a duty to defend the realty management company that had been sued based on policy exclusions in the coverage (American Safety Indemnity Company v. 612 Realty LLC, et al., No. 600347/2004, N.Y. Sup., New York Co.; 2009 N.Y. Misc LEXIS 2045). (Opinion in Section D. Document #14-090812-005Z.) American Safety Indemnity Co. sued 612 Realty LLC and Amaurys Rodriguez, an infant , by and through her mother Maria Ventura — and Maria Ventura individually — in the New York County Supreme Court.
