Maryland Market-Share Bill Dies As Session Ends

The Maryland legislative session ended April 13 without any action being taken on a measure that would have authorized the City of Baltimore to pursue the former makers of lead paint under a market-share liability theory of recovery (See April 2009, Page 12). HB 1156 would have apportioned liability for lead-paint injuries in the city based on the market share held by paint companies that formerly made lead paint.
