Christopher Kydd sued Daarta Realty Corp. and Abraham Lasker in the Kings County Supreme Court, alleging that he had been poisoned as a result of exposure to lead-based paint at a premises owned and controlled by Daarta and Lasker. Daarta and Lasker moved for summary judgment dismissing the complaint, but the Supreme Court denied the motion. The defendants appealed to the Second Department Supreme Court Appellate Division.
