Two environmental groups pursue legal challenge to EPA rule that improved western stream sediment control

Two environmental groups are pursing a court action that, if successful, will negate a revised Environmental Protection Agency (EPA) regulation that allowed western coal mines to control in a more environmentally effective way stream sediment following a rainstorm. The Citizens Coal Council (CCC) and Kentucky Resources Council (KRC) filed briefs in the 6~(th) Circuit Court of Appeals last November. The groups challenged the rule on technical grounds, even though it resolved conflicting regulatory requirements that previously complicated stream sediment control in the western U.S. and actually led to environmental harm in some cases.
