Market economy status clauses

The following is an edited version of a paper on this issue given by Liu Jianwei from the legal department of the China Chamber of Commerce of Metals Minerals & Chemicals Importers & Exporters (CCCMC) at the 5th Chinese Industrial Minerals Conference in shanghai held from 12-14 October 2003. MPW has often commented on the high number of antidumping cases against China in recent years. A central (and much maligned by the Chinese) element of many antidumping investigations against China is the use of other countries as surrogates to determine the "normal value" of Chinese mineral exports. This is done as organisations such as the EC and US Dept of Commerce still do not regard China as a market economy. China has become the world's number one anti-dumping target over the past ten years. WTO records show that the import and export value of China accounted for less than 5 percent of the total global trade in recent years but about 14 percent of the world's overall antidumping cases are against Chinese products.
