The first prosecution to be brought under Namibia's Diamond Act of 1999 by the Ministry of Mines and Energy (MME) was rejected by the court at the end of last month. The case was against two foreign nationals engaged in authorised diamond exploration along the country's Skeleton Coast at Toscanini, 170 km north of Henties Bay (MJ, March 22, p.217). Bruno de Vicentiis, a director of Safuan Resources, and David Visser of Rowbow Exploration, a company contracted by Safuan, faced four charges, including their alleged failure to obtain permits to enter and work in a restricted area, and failure to enter the details of a batch of recovered diamonds into a register.The State's case was undermined steadily by conflicting or weak evidence, and by the end of the hearing the prosecution lawyer conceded that the two men had to be acquitted.
