Research for the Scottish Executive by David Kirk & Associates has been published, and presents findings on the review of old mineral permissions in Scotland. The aim of the study was to assess the progress that has been made in the review and to ascertain how effective the review procedures have been in practice. Copies of the Report 'Review of Old Mineral Permissions' cost 5 pounds from the Stationery Office Bookshop, Edinburgh (tel: 0870 606 5566): it is also at www.scotland.gov.uk The study involved the collection and analysis of data from a questionnaire survey of all planning authorities, case studies, interviews, and a selective review of planning registers. It found that the review resulted in significant progress towards ensuring that such permissions have been updated to reflect current expectations for protection of the environment consistent with best working practices. The current statutory provisions had been effective. The review process had been the subject of considerable delay, which varied significantly between different planning authorities across Scotland. The principal factors influencing progress were the complexity of individual cases, staff resources and relative priorities within planning authorities. The effectiveness of the review procedures appear to centre on the opportunity provided for dialogue and reappraisal of the working arrangements and planning circumstances relevant to each site.
