In Zeiler Farms, Inc. v. Anadarko E&P Co., LP, Civil Action No. 07-cv-01985-WYD-MJW, 2009 WL 890716 (D. Colo. Mar. 31, 2009), the court found that a surface owner's agreement governed questions regarding use of the surface for oil and gas operations and that the accommodation doctrine and Colo. Rev. Stat. § 34-60-127 did not apply. Id. at *4. This is a federal district court case interpreting Colorado law. The issues were before the court on a motion for summary judgment by Unioil, Inc., the lessee of the oil and gas lease covering the lands.
