As previously reported, on January 14, 2010, the Michigan Department of Environmental Quality affirmed the issuance of the first permit under a new non-ferrous metallic mineral mining statute (known as "Part 632" of the Michigan Natural Resources and Environmental Protection Act, Mich. Comp. Laws 324.63201-.63223) to the Kennecott Eagle Minerals Company (Kennecott). See Vol. XXVII, No. 1 (2010) at 9, of this Newsletter. The permit, along with the associated air and groundwater discharge permits, authorized Kennecott to build and construct an underground nickel-copper mine northwest of the City of Marquette in Michigan's Upper Peninsula.
