Court Defers to Agency Decision Not to Model Ozone

Two nongovernmental organizations (NGOs) filed an action in the U.S. District Court for the District of Colorado challenging decisions by the U.S. Forest Service (Forest Service) and Bureau of Land Management (BLM) to approve a natural gas drilling project of up to 45 wells in the White River National Forest in western Colorado. In Natural Resources Defense Council v. Vilsack, No. 08-cv-02371-CMA, 2011 WL 3471011 (D. Colo. Aug. 5,2011), the court affirmed the decisions of the Forest Service and BLM.
