Shale Gas, Pipelines, and FERC

On November 14, 2011, FERC issued a certificate of public convenience and necessity in Central New York Oil and Gas Co., No. CP10-480, 137 FERC f 61,121 (2011) (CNYOG), granting authorization to CNYOG to construct a pipeline, with certain conditions, in the heart of the Marcellus Shale country. The case is significant because it is indicative of FERC's willingness to proceed with the certification (essentially license to build) in the face of the environmental community's aggressive and outspoken opposition to the pipeline's construction. CNYOG is the subsidiary of Inergy, L.P., which operates an existing gas storage facility in the area.
