Defense Weirdict in Kentucky Carbon Monoxide Lawsuit

On April 5, a jury in Louisville, Ky. returned a defense verdict in favor of an appliance service company in a multiple-injury carbon monoxide (CO) exposure case. The jury found that the service company used ordinary care when it performed a temporary repair on a hotel's water heater. The case is Riddle v. Davis & Davis Plumbing. The Comfort Suites hotel in Louisville had two gas-fueled water heaters. The exhaust vent ductwork for these water heaters had several bends before it reached the outside of the hotel, and the exhaust fan for the main water heater was hard-wired into the system so that it ran constantly. That fan ran until its motor burned out on Jan. 19, 2008, shutting down the water heater.
