RWE plans to auction an annual 1,600MW of power station capacity on a quarterly basis over a four year period from 2009, the starting price to be the full cost of one depreciated coal or lignite power station. The auction is not entirely voluntary. Rather it is part of an agreement in which the Federal Cartel Office (FCO) has dropped its case against RWE for alleged unlawful inclusion of CO2 costs (that is, the market price of CO2 certificates that had been allocated for free) in its industrial power pricing, in return for RWE's auctioning programme.
