ENERGY MARKETERS ASK FOR EXPLICIT STATEMENT IN TRANSPARENCY RULE THAT RETAIL ACCESS PROGRAM REPORTING EXCLUSION SHOULD BE APPLIED TO FORM 552

The National Energy Marketers Association(NEM)on 10/20/08 asked the Commission to clarify the Form No.552 retail transaction reporting exclusion,as modified in Order 704-A(RM07-10).The final rule required wholesale buyers and sellers of more than a cfe minimis volume of physical natural gas to report annual aggregate purchases and sales on a new Form 552,Annual Report of Natural Gas Transactions.The form will have to be submitted by 5/1/09 for transactions occurring during the calendar year 2008 and by May 1 of each year thereafter for transactions occurring the previous year.
