SEQUENT ENERGY MANAGEMENT AND NICOR ENERCHANGE FILE JOINT PETITION FOR TEMPORARY WAIVERS OF CAPACITY RELEASE REGULATIONS AND POLICIES

On 9/14/11, Sequent Energy Management, LP and Nicor Enerchange, LLC1 ((RP11-2565) submitted a joint petition for temporary waiver of certain FERC capacity release regulations and policies and any applicable pipeline tariff provisions, in order to allow Enerchange to transfer some of its transportation and storage service agreements to Sequent after the proposed merger of their respective parent companies. Specifically, the petitioners request waiver of the following: 1) the shipper-must-have- title policy, 2) the prohibition on buy-sell arrangements, 3) the prohibition on tying, 4) certain bidding requirements, and 5) restrictions on capacity releases below or above the applicable maximum tariff rate, and any related pipeline tariff provisions.
