NEB Approves Trans Mountain Rate Methodology for Proposed Expanded Petroleum Pipeline System

On 5/16/13 the National Energy Board (NEB) of Canada approved the application by Trans Mountain Pipeline ULC (a Kinder Morgan Canada project) for the rate (toll) methodology that would be implemented on the proposed Trans Mountain expanded petroleum pipeline system, if the system is eventually expanded. In all, 13 “large, sophisticated shippers” (in the NEB’s perception) executed long-term agreements and 11 of these took no issue with the toll methodology. The Board found, “on balance, that the methodology will produce rates that will be just, reasonable and not unjustly discriminatory.” This application did not seek Board approval to construct the expanded system. The NEB does not currently have a facilities expansion application before it from Trans Mountain regarding the future planned expansion of the pipeline. (Toll Order TO-004-2013).
