Disclosure of Purported “Privileged” Documents is Ordered By FERC in Texas Eastern and Arlington Storage Proceedings

Last February Texas Eastern Transmission, LP (CP13-84) filed an application with FERC for authorization under section 7 of the Natural Gas Act (NGA) and Part 157 of the regulations to construct and operate the Texas Eastern Appalachia to Market 2014 Project (TEAM 2014 Project). On 8/5/13, ConocoPhillips Co. requested that the Commission require Texas Eastern to file a form of protective agreement and provide ConocoPhillips with certain requested non-public documents upon receipt of ConocoPhillips’ executed protective agreement. By order, issued October 8, the Commission is requiring Texas Eastern to enter into a protective agreement with ConocoPhillips and to provide ConocoPhillips with a copy of the requested non-public documents.
