ROCKIES EXPRESS PIPELINE AND ULTRA RESOURCES PROTEST FERC REQUIRING REX TO ALLOW BACKHAUL SERVICE CUSTOMERS TO USE FORWARD-HAUL SERVICE ON A SECONDARY BASIS AT A LOWER RATE THAN RATE PAID BY COMMITTED SHIPPERS

Rockies Express Pipeline LLC (REX) (RP11-2096) sought rehearing of FERC's order issued June 17 that accepted and suspended, subject to conditions, proposed tariff records it filed on May 6, as amended on May 18, that is know as the BHS Proposal. The BHS Proposal sought approval of a new mainline displacement-only backhaul service under a new Rate Schedule BHS (Backhaul Transportation Service). FERC scrutinized the proposal generally and imposed a condition on REX "so that a BHS service customer may use secondary points in a manner that would allow for forward-haul [transportation]," stating that prohibiting the use of secondary receipt points in this manner "is contrary to the Commission's policy of flexible receipt and delivery points."
