Enforcement Package Spotlighted at Final 2009 Sunshine Meeting of FERC; FERC Chairman Wellinghoff Dissents in Jordan Cove LNG Project; Suedeen Kelly Departs

The last open meeting of the year, held by FERC on 12/17/09, marked the departure of Commissioner Suedeen Kelly, who is serving a grace period through the end of the 1st session of the 111th Congress, which adjourns this month. She has been a member of the Commission since November 2003.The agenda featured two enforcement orders (PL10-1 and PL10-2), accompanied by an annual Report on Enforcement (AD07-13) for fiscal year 2009 by the Office of Enforcement (OE) under new Director Norman Bay. The prior Policy Statement on Enforcement had instructed staff to prepare annual statistical reports on OE enforcement activities. Staff gathered data on market behavior, market participants, and market rules. The report drew praise from all Commissioners, especially Philip Moeller. (See adjacent article.)
