Anadarko, Freeport-McMoRan Ask FERC to Waive Capacity Release Requirements to Facilitate Gulf of Mexico Assets Sale

In a joint application on October 24, two oil and gas exploration and production companies, Freeport-McMoRan Exploration & Production LLC (FMEP) and Anadarko US Offshore LLC (RP17-51), requested temporary and limited waivers of FERC’s capacity release rules to facilitate the $2 billion sale of FMEP’s Gulf of Mexico assets to Anadarko. The waivers are needed during the transaction so that the assets are not subject to the Commission’s posting and bidding rules for capacity releases, among other things. The companies also requested a shortened comment period in the proceeding and expedited treatment from FERC. To be able to meet a planned sale date of 12/12/16, the companies want the Commission to act on their petition by 12/2/16. They would like the waivers to stay in place for 120 days.
