Pre-trial Documents Position Parties For Litigation of Rates That El Paso Natural Gas May Charge Its “Protected Shippers”

Pre-trial briefs were submitted on or about May 23 to Presiding Administrative Law Judge Judith Dowd to kick off that case examining appropriate rates and remedy pursuant to Article 11.2(b) of the 1996 Settlement (RP95-363) that El Paso Natural Gas Co. (RP10-1398) has been attempting to interpret and implement for a long time. The Commission Trial Staff claim EPNG’s compliance recourse rates improperly shift costs to shippers eligible for rate protection under Article 11.2(b). Furthermore, Trial Staff urged the Presiding Judge to direct EPNG to file recalculated rates for such eligible shippers that comply with the 1996 Settlement and to pay refunds for the period until EPNG’s prospective rates become effective.
