In the Aug. 25 Federal Register (75 FR 52425), FDA issued a notice announcing the availability of a draft guidance document entitled "Guidance for Industry: Questions and Answers Regarding Implementation of the Menu Labeling Provisions of Section 4205 of the Patient Protection and Affordable Care Act of 2010." These provisions require that certain chain restaurants and similar retail food establishments with 20 or more locations are to provide calorie information, as well as other nutrition information, for standard menu items, food on display and self-service food. Section 4205 also requires vending machine operators who own operate 20 or more machines to disclose calories for articles of food. Retail food establishments with fewer than 20 locations and vending machine operators with fewer than 20 machines may elect to be subject to these requirements by registering with FDA every other year.
