Discussions on the approach taken by the Canadian courts to issues of free speech, as it relates to the regulation of food and drugs are presented. Also, some of the recent changes in the Canadian food and drug regulation are discussed, as well as the potential impact of these changes on the freedom of expression as provided by Canada's constitution. The general framework of the Canadian Food and Drugs Act (the Act) as it relates to the regulation of food and drug advertising, and the new regulations relating to nutritional labelling, nutrient content claims and diet-related health claims is also discussed. The last part of the article presents some case law that has addressed the constitutionality of the advertising restrictions set out in the Act, as well as an analysis of the new regulations with respect to diet-related health claims.
